1. Who we are
Back to Zero (the “Service”) is an online application provided by Avila Integradores de Soluciones SA de CV, a Mexican company with its address at Av. Insurgentes 4001 Interior 615, col. Colinas de San Jerónimo, Monterrey, Nuevo León, México, C.P. 64630 (“we”; www.avilaintegradores.com). By creating an account or using the Service you accept these Terms on your own behalf and, if the account belongs to a company, on its behalf (the “Customer”).
2. The Service
Back to Zero helps sales teams keep a closing rhythm: it counts the days without a sale, records closed sales, calculates recurring revenue against a goal and sends the team a daily email. It is not a customer relationship management (CRM) system nor an accounting or tax system, and its calculations are for information only.
3. Accounts and security
- You must have legal capacity to contract and provide truthful information. Each person uses their own account.
- You are responsible for keeping your credentials safe and for activity under your account. We recommend enabling two-factor authentication (2FA).
- The Customer’s admin decides who has access and with which role, and may remove it at any time.
4. Plans, payments and cancellation
- The Free plan allows up to 2 people. Paid plans are charged in advance, in US dollars, monthly or yearly, through Stripe, and renew automatically until cancelled.
- The subscribed price is honored as long as you keep the same plan and billing period. Price changes apply to new subscriptions.
- You may cancel at any time from Billing: the plan stays until the end of the paid period and then the account moves to the Free plan. There are no refunds for partial periods unless applicable law requires otherwise.
- If a payment fails, the Service keeps working while Stripe retries the charge; if retries are exhausted, the account is paused until payment is completed.
- Published prices include applicable taxes and the total you pay is always the published price. In Mexico, if you register your tax details you receive your CFDI with VAT itemized; otherwise your payment is included in the general-public invoice. Customers abroad who register their tax details are invoiced at a 0% rate as an export of services. CFDIs are issued in Mexican pesos at the exchange rate applicable on the payment date.
5. Your data
Data entered by the Customer (sales, customers, goals, team) belongs to the Customer. We process it only to provide the Service, as described in the Privacy Notice and the Data Processing Agreement. Our team does not access a company’s data unless its admin grants temporary support access. You may export your data at any time.
6. Acceptable use
You may not use the Service for unlawful activities, spam, attempts to access other accounts or data, security breaches, reverse engineering, unauthorized resale or deliberate overloading. We may suspend accounts that break these rules.
7. Referrals
When a company signs up with your referral link, pays its first charge and 14 days pass without a refund, both companies earn one free month, up to 12 months per year per company. We may void benefits obtained abusively.
8. Availability and changes
We aim for the Service to be always available, but there may be interruptions for maintenance or causes beyond our control. We may improve or modify features; if a change materially affects your plan, we will notify you reasonably in advance.
9. Intellectual property
The Service, its brand, design and code belong to Avila Integradores de Soluciones SA de CV. We grant you a limited, non-exclusive, non-transferable right to use it while your account is active.
10. Warranties and liability
The Service is provided “as is”. To the extent permitted by law, we do not guarantee business results and our total liability to the Customer is limited to the amounts paid in the 12 months before the event giving rise to it. We are not liable for indirect damages, lost profits or data loss caused by third parties or by the Customer.
11. Closing the account
The admin may close the account from Settings. The account is paused for 30 days (during which it can be reactivated or its data exported) and then we permanently delete its data; backups are deleted within the following 30 days.
12. Governing law and jurisdiction
These Terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Monterrey, Nuevo León, waiving any other jurisdiction, without prejudice to any non-waivable consumer rights. This is a translation; the Spanish version prevails.
